Hiram Samuels' Heirs to Hiram R. Samuels - 43 Acres

Following the death of Hiram Samuels, his heirs went to court to have his land divided among them. In the deed below, Hiram R. Samuels received his portion, Lot #6, 43 acres that adjoined land owned by Lem Nichols as shown in the plat drawing below.

Whereas in the action of Elizabeth Cundiff &c, plaintiff, against James A. Samuels &c, defendants, then pending in the Bullitt Circuit Court for a partition of the real estate of Hiram R. Samuels, dec'd, an order was entered at the May Term 1883 directing James Caswell, Samuel Hornback and Casper Herps as commissioners of said court to make division and allotment of said real estate between the parties to said action, and the said real estate was divided in accordance with said order, and said commissioners having made their report of division at the November Term 1883 of said court appointed the undersigned E. W. Hall a special commissioner to made deeds of partition, conveying to each party the lands and property allotted to them in severally. Now therefore this indenture made and entered into this 17th day of November 1885 between Elizabeth Cundiff, Richard Cundiff, Ann Short, John Short, John Samuels, Howell Samuels, James A. Samuels by E. W. Hall, commissioner aforesaid of the first part and Hiram R. Samuels of the second part. Witnesseth that for and in consideration of the premises, and in obedience to said order, the parties of the first part, by E. W. Hall, commissioner aforesaid, have sold and do hereby convey to said party of the second part and his heirs and assigns forever the lot No. 6, described as follows, viz:

A tract of land lying in Bullitt County, Kentucky, and bounded as follows.

Beginning at two beeches where Mays' patent line crosses Cow Branch, thence with the same N 59° W 142 poles to a stone, corner to Lem Nichols, and with the same N 14° E 45 poles to a stake two yards west from a beech, thence N 17° W 34 poles to a stake in a drain near a beech in Paulley's line and corner to Lot No. 5, and with the same S 47 1/3° E 193 poles to a stake at Cow Branch, thence down the same with its meanders to the beginning, containing 43 acres.

To have and to hold the same with the appurtenances unto the party of the second part, his heirs and assigns forever. Witness my hand this 17th day of November 1885.
