Thomas Joyce to Richard P. Simmons - Two Shepherdsville Lots

In 1835, Thomas Joyce sold parts of Shepherdsville lots 39 and 40 to Richard P. Simmons, likely as part payment for a debt owed to Simmons.

Bullitt County Deed Book H, Pages 150-151

This indenture made this twenty seventh day of January 1835 between Thomas Joyce of Bullitt County and State of Kentucky of the one part, and Richard P. Simmons of the same county and state of the other part. Witnesseth that the said Thomas Joyce for and in consideration of the sum $861.18 to him in hand paid before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, hath given, granted, bargained and sold, and by these presents doth give, grant, bargain and sell, alien, release, convey and confirm unto the said Richard P. Simmons his, the said Thomas Joyce's house and lot (now in the occupancy of Robert F. Samuels), being parts of lots No. 39 & 40 in the new plan of the town of Shepherdsville conveyed to the said Thomas Joyce by Nathan Harris and by William Jones, commissioner for and on behalf of James Brown's heirs. To have and to hold the said house and lot with all the appurtenances therein to belonging unto him the said Richard P. Simmons, his heirs, executors, administrators and assigns, and to his and their only proper use, benefit and behoof forever.

And the said Thomas Joyce convenants and agrees to and with the said Richard P. Simmons that he will and his heirs shall warrant and forever defend the said described lot and appurtenances unto him the said Richard P. Simmons, his heirs, executors, administrators and assigns from the claim or claims of all and every person or persons lawfully claiming or to claim the same.

Provided nevertheless and these presents are on this condition - that if the said Thomas Joyce shall well and truly pay or cause to be paid unto the said Richard P. Simmons, his heirs &c the following sums of money for which the said Thomas Joyce has this day executed his notes to the said Richard P. Simmons within two years from the date hereof, to wit: one note for $400 payable two years after date, and one note for the sum of $476.83 7 mills within two years from the date hereof, and one note for $137.14 payable two years from the date, then these presents shall cease and become utterly null and void, and the house and lot and appurtenances hereby conveyed shall be re-conveyed to the said Thomas Joyce, his heirs &c anything herein contained to the contrary notwithstanding.
