John and Nancy McDowell to Humphrey Simmons

This indenture made this fifteenth day of September One thousand eight hundred and thirty six between John McDowell Sr. and Nancy his wife of Bullitt County and State of Kentucky of the one part and Humphrey Simmons of the same place of the other part. Witnesseth that the said McDowell for and in consideration of the sum of three thousand dollars current money of the United States to him in hand paid, to said McDowell, has and does by these presents rant, bargain, and sell unto the said Humphrey Simmons and to his heirs forever the following tract of land in Bullitt County on Salt River and bounded as followeth. Beginning at the corner of the land here sold and the Shepherd's 900 acre tract on the bank of Salt River now the division corner between said McDowell and Francis Maraman and running with the line of said 900 tract and this tract out from the river (the division line of said Maraman and McDowell) to the middle of the big road as it now runs from Shepherdsville to Mount Washington; thence with the middle of said road as it now runs towards Mount Washington to the division line of the tracts of said McDowell and Simmons and Phelps, thence with the division line of said Simmons and the tract here sold to the river, and then down Salt River with its meanders to the Beginning, the big road as it now runs and the middle thereof is the boundary between this tract and McDowell equally distant from each. This tract here sold is called the Paroquet Spring tract of land and contains 250 acres more or less with its appurtenances.

To have and to hold the said tract of land and appurtenances thereunto belonging unto him the said Humphrey Simmons and to his heirs forever. And said John McDowell and wife for themselves and their heirs do hereby covenant and agree to and with the said Humphrey Simmons that the said McDowell will and his heirs shall warrant and forever defend the land here sold unto the said Humphrey Simmons and to his heirs forever against the claims of all other persons whatsoever. And it is agreed that said McDowell shall and he does hereby retain a lien on the said land for one thousand dollars part of the purchase money due. And it is further agreed by and between the said grantor and grantee that in case the lad here sold is lost by any other or better claim in law and said Simmons be evicted therefrom then said McDowell is to pay back the said Simmons the purchase money and legal interest thereon and no more. And it is further agreed that said McDowell and family are to have at all times free of cost or charge the use of the medical spring water. State of Kentucky, Bullitt County, towit. I Noah C. Summers, clerk of the county court for the county aforesaid, do certify that this deed from John McDowell and Nancy his wife to Humphrey Simmons was this day produced to and in my office by the grantor and acknowledged by the said John McDowell to be his act and deed. And the said Nancy being examined by me privily and apart from her husband declared that she did freely and willingly seal and deliver the said writing and wishes not to retract it. And acknowledges the said writing again shown and explained to her to be her act and deed, and consenteth that the same may be recorded. Whereupon the said deed together with the foregoing certificate hath been duly recorded in my office. Given unto my hand this 15th day of September 1836. (signed) N. C. Summers, CBCC
