R. P. Simmons' Heirs to George Miles - Four Shepherdsville Lots

In 1846, the heirs of Richard P. Simmons sold four Shepherdsville lots (17, 18, 19 & 33) to George Miles. We are still trying to determine when these lots came into the possession of Simmons. Miles later sold the four lots to John Rickerson.

This indenture made this 12th day of October 1846 between Nicholas Simmons, Alfred Simmons, Jacob W. Bowman and Mary Jane his wife, Solomon N. Brooks and Elizabeth his wife, Richard H. Field, A. J. Field and Abram Hamlet Field, heirs at law of Richard P. Simmons dec'd by Noah C. Summers, commissioner for them for that purpose of one part, and George W. Miles of the second part.

Witnesseth that whereas the said heirs of R. P. Simmons dec'd filed their petition in the Bullitt Circuit Court praying a sale of the real estate of said R. P. Simmons dec'd agreeably to law, and said court did, by its order and decree in said cause of the 10th of April 1846, direct and appoint Henry C. Thomas commissioner to make sale of the real estate of said decedent as therein decreed and report the sales to said court; and said Thomas, commissioner as aforesaid, did as by said decree directed sell said real estate of said Simmons dec'd on the 18th of May 1846, and amongst other estate sold, said George W. Miles purchased four half-acre lots in the town of Shepherdsville, Nos. 17, 18, 19 & 33 for the sum of $50, and said commissioner returned his said report of sales to the Bullitt Circuit Court at their October Term 1846, and said report and sales were confirmed by the order and decree of said Court. And said Court appointed N. C. Summers commissioner on the part of said R. P. Simmons' heirs to convey said property so sold by said commissioner to the several purchasers.

Now therefore in consideration of said decree, sales and orders in the cause, they the said R. P. Simmons' heirs, parties of the first part by said Noah C. Summers, commissioner for them for that purpose, have sold, conveyed and confirmed, and by these presents do sell, convey and confirm unto him the said George W. Miles and to his heirs and assigns forever the said four lots, Nos. 17, 18, 19 & 33 in said town of Shepherdsville in the new plan thereof with their appurtenances. To have and to hold the said for half-acre lots and appurtenances aforesaid to him the said George W. Miles and to his heir and assigns forever against the claims of them the said Richard P. Simmons' heirs, the parties of the first part, and their heirs and assigns forever, and against the claims of all other persons as fully as by law and the orders and decrees in the said cause and commissioner can warrant title for said heirs, without any individual responsibility on said commissioner.
