Benjamin Summers and Thomas Wells - A Land Swap

On 16 Feb 1829, Benjamin Summers and Thomas Wells exchanged tracts of land on the waters of Cedar Creek, a tributary of Floyd's Fork. In the first deed below, Summers deeded 4 1/2 acres to Wells; and in the second deed, Wells deeded 15 3/4 acres to Summers.

This indenture made this 16th day of February 1829 between Benjamin Summers of Bullitt County, Kentucky of one part and Thomas Wells of the same place of the other part. Witnesseth that the said Summers for and in consideration of the sum of one dollar to him in hand paid, the receipt of which is hereby acknowledged, he has sold and does by these presents sell and convey unto said Wells the following tract of land in Bullitt County on the waters of Cedar Creek and containing 4 1/2 acres and bounded as follows, to wit.

Beginning at a black walnut, thence N 56° W 26 poles to a stake in a road, thence N 52° E 33 poles to a stake, thence S 54° E 17 poles in the corner of Wells' fence, thence S 36° W 32 poles to the beginning.

With the premises and appurtenances to the same belonging, to have and to hold the same to him the said Thomas Wells and his heirs and assigns forever. And said Summers covenants and agrees to and with said Wells to warrant and defend the said land aforesaid to him said Wells and to his heirs and assigns against himself and those claiming under him and against all and every person or persons whatsoever. Witness the hand and seal of the grantor the date above.

This indenture made this 16th day of February 1829 between Thomas Wells of Bullitt County, Kentucky of one part and Benjamin Summers of the same place of the other part. Witnesseth that the said Wells for and in consideration of the sum of one dollar to him in hand paid, the receipt of which is hereby acknowledged, he has sold and does by these presents sell and convey unto said Summers the following tract of land in Bullitt County containing 15 3/4 acres and bounded thus.

Beginning at a stake in the Smith's Mill Road and running thence S 52° W 6 poles to a stake in said road, thence N 52° West 14 poles to a white oak, thence S 75° W 24 poles to a black oak, thence S 65° W 40 poles to two sycamores and white oak on the branch, thence up said branch N 12° W 42 poles to two willow trees, thence N 36° E 28 poles to an ash and hickory, thence S 56° E 82 poles to the beginning with its appurtenances.

To have and hold the land here sold to said Summers and his heirs forever. And said Thomas Wells covenants and agrees to and with said Summers to warrant and defend the said land to him and to his heirs forever against the claim of himself and those claim of himself and those claiming under him, and against all other claims whatever. Witness the hand and seal of the grantor the date above written.
